Inmates Rights and Your Responsibilities
PREA Limited Service Training: Read and initial each statement, and then sign at the
bottom.
The Law: Congress passed The Prison Rape Elimination Act (PREA) in 2003. PREA
standards require prisons to prevent, detect, and respond to sexual abuse and sexual harassment.
Zero Tolerance Standards: The Idaho Department of Correction has zero tolerance for all forms of sexual abuse and sexual harassment. All complaints will be thoroughly investigated.
Definitions:
•Sexual abuse includes a broad spectrum of unwanted activity from sexual touching to rape.
Inmates can never consent to sexual contact with any officer, employee, or agent of the Idaho
Department of Correction (IDOC).
•Sexual harassment includes unwanted sexual advances, gestures, and offensive sexual
actions. You can request a PREA definitions handout. It provides detailed definitions.
Rights: PREA protects inmates’ rights to be free from sexual abuse, and sexual harassment.
PREA also protects inmates and staff from retaliation for reporting and investigating allegations of
abuse and harassment. Inmates can report such allegations to anyone, at any time, by any method.
Responsibilities: Any staff member, contractor, or volunteer who receives any report of in
custody sexual abuse or sexual harassment, or observes or suspects such conduct, is required to report it to security staff immediately. I understand that failing to report abuse is a violation of IDOC
policy.
First Responder: If you are the first person on the scene of a sexual abuse incident, request that the victim not destroy evidence and notify security staff immediately to get help.
Detecting Abuse: Everyone reacts to trauma differently. Some warning signs of sexual
abuse may include depression, suicidal comments, habit changes, and housing changes requests.
Inappropriate Relationships: Sexual contact of any kind between a staff member,
contractor, or volunteer and an inmate is inappropriate and not allowed. This includes kissing and
sexual touching. It is a felony for any officer, employee, or agent of the IDOC to have sexual contact with an inmate. Such sexual contact is punishable by up to life in prison.
Prevention: Protect yourself and others. Be aware of your surroundings. Understand your
rights and obligations.
Always maintain professional relationships and communication with inmates.
•Avoid sexual comments or jokes, and report any inappropriate comments heard.
•Know and follow the rules. Never bring in contraband, or break other rules.
This form is to be used for individuals who rarely visit facilities, have limited responsibilities while in
the facility and/or limited contact with inmates. It is not required if they are to be escorted at all times while visiting. File in facility PREA training file.
