GOVERNING POLICY STATEMENT It is the department’s policy to reduce recidivism by having and maintaining community reentry centers to allow eligible minimum custody residents the opportunity to reenter and work in the community before release from custody. D. PURPOSE To establish requirements and procedure for residents operating department vehicles while assigned to a community reentry center. E. RESPONSIBILITY 1. Community Reentry Center Manager The community reentry center manager is responsible for ensuring staff and residents under their authority comply with the requirements of this SOP including designating the decision-making authority under its procedures. F. DEFINITIONS 1. Community Reentry Center Manager: The person designated by the chief of the Probation & Parole Division to oversee, manage, or operate a CRC. 2. Correctional Management System (CMS): a digital platform used by correctional agencies to store, manage, and analyze comprehensive data about individuals throughout their entire criminal justice process, including intake, sentencing, incarceration, parole, and probation, allowing for informed decision- making regarding their supervision and rehabilitation. This includes systems such as Reflections, CIS, and Atlas. 3. Resident: A person who has been convicted of a crime against the laws of the state and ordered into the care and custody of the Board of Correction. Resident includes any use in Idaho law, Board of Correction rule, or IDOC policy or procedure of the terms “offender(s),” “prisoner(s)”, “inmate(s)”, “incarcerated person(s)”, or any other term referring to a person residing in a correctional facility in the care and custody of the Board of Correction. The CRC manger may authorize an eligible resident to operate a state vehicle as permitted in this SOP. b. To operate a department vehicle, a resident must have a valid Idaho driver’s license. A resident who receives authorization to operate a state vehicle must do so in compliance with this SOP and federal, state, and local laws. c. Residents are not authorized to have a driver’s license in their possession. If a resident is required to drive in the scope of their employment, the resident’s employer must request, in writing, that the resident receive an IDOC Restricted Driving Permit. 2. Documentation Staff at each community reentry center must keep a log of: a. Driving permits issued b. Resident’s name c. IDOC identification number d. Driver’s license number and expiration date e. Permit issued date f. Permit canceled date 3. Procedure for Issuing an Restricted Driving Permit Document Number: 614.001 2 Title: Resident Drivers Page Number: 4 of 8 Idaho Department of Correction Functional Roles and Responsibilities Step Tasks ILETS Operator/ Staff 1 1. Before hiring a resident as a driver, check the resident on ILETS for the resident’s driving record for the last five years. The following conditions disqualify the resident from driving: a. One or more DUI convictions b. One or more reckless or inattentive driving convictions c. Instant offense is a DUI conviction d. Conviction for eluding in a motor vehicle e. If the resident requires a SR22 Insurance Form 2. Ensure the resident has a valid Idaho driver’s license or is eligible to have one reinstated or issued. CRC Manager or designee 2 Before approving, review the ILETS information, Presentence Investigation Report, and state repository for vehicle related incidents. Facility Sergeant 3 Interview the resident driver candidate, discussing history, experience, and qualifications, and reviewing department expectations. Facility Sergeant or Designee 4 Ensure that new drivers ride along with an experienced resident driver for one to two weeks before receiving a permit. Determine the length of time based on the resident’s knowledge of area. 5 Complete the Restricted Driving Permit. Fill out all fields within the permit electronically and print. 6 Sign, date, and send the completed Restricted Driving Permit to Idaho Transportation Department, Attn: Driver Services “Suspension Unit” via fax or email. Maintain the original for facility records. Document Number: 614.001 2 Title: Resident Drivers Page Number: 5 of 8 Idaho Department of Correction 7 Document all pertinent information into the facility’s Work Release Drivers Permit Log. 8 Ensure the approved new resident driver completes a two-week training period with an experienced driver and is tested by the sergeant or designee using staff ride-along Driver Checklist. 4. Procedure for Removing Driver’s License Restriction a. The facility sergeant or designee must remove the driver’s license restriction from a resident driver if the resident is: i. Released from custody ii. Transferred out of the facility iii. No longer permitted or needed to drive facility vehicles due to a vehicle accident for which the resident driver is cited or at fault, disciplinary action, transfer to work release, or at the discretion of the CRC manager. b. Please note: If no one releases the restriction, the resident’s license remains restricted with the Idaho Department of Transportation. Functional Roles and Responsibilities Step Tasks Facility Sergeant or Designee 1 Obtain the original Restricted Driving Permit for the resident who is no longer driving a department vehicle and complete the ‘Remove Restriction’ portion. 2 Sign, date, and send to the Idaho Transportation Department, Attn: Driver Services “Suspension Unit” via fax or email. 3 Record completion in the facility’s Work Release Drivers Permit Log. 5. Driver Safety a. CRC staff must conduct random urine analysis tests and alcohol breathalyzer tests on 10% of all resident drivers each month. Staff conducting the test must enter the results in the CMS. b. Resident drivers are responsible for immediately reporting any vehicle maintenance issues to their supervisor. c. The CRC manager is responsible for ensuring all state vehicles driven by residents are equipped with tracking and monitoring device(s). The facility sergeant or designee uses the GPS fleet tracking device and interior monitoring devices to ensure driver safety through daily monitoring and reviewing of a wide range of driver behaviors events including critical, major, moderate, and minor violations. e. To allow for timely intervention, the monitoring system must be configured to send real-time alerts when the following events occur. Additional events can be added for real-time alerts at the discretion of the CRC manager or designee. i. Hard acceleration ii. Hard braking iii. Smoking/Vaping iv. Phone distractions v. Seatbelt unfastened vi. Rollings stops vii. Speeding f. When staff receive an alert for a violation from the monitoring system, staff will review video and follow up with resident based on the findings, including for any discipline or corrective action. g. The facility sergeant or designee must facilitate a driver safety meeting once a month with all resident drivers in the facility. Areas to be covered may include: i. Road safety and laws ii. Weather factors iii. Attentive driving iv. Dress and appearance v. Vehicle care vi. Driver education and skills vii. Defensive driving video The staff conducting this must enter notes in the CMS. h. Corporals and above must conduct quarterly ride-alongs with each approved resident driver. The staff conducting this must enter notes in the CMS. 6. Collision or Traffic Violation a. Collisions i. Resident drivers involved in a collision must immediately stop at the scene and give assistance if needed. Document Number: 614.001 2 Title: Resident Drivers Page Number: 7 of 8 Idaho Department of Correction ii. Resident drivers must cooperate with law enforcement authorities and involved parties. iii. Resident(s) must notify the facility via radio, if possible, or have law enforcement contact the facility. iv. Facility medical staff (or On Call Medical Staff for after hours) must be notified to check all vehicle passengers upon return to the facility. v. CRC staff must train resident drivers on the State of Idaho Auto Accident Report Guide. If a collision occurs, resident drivers must follow each step of the guide and gather information to complete required forms or reports. vi. If a CRC staff member is available, they should report to the scene to take pictures and assist with completing the State of Idaho Auto Accident Report Guide. vii. Unless law enforcement holds the vehicle, the staff member on scene will assess the damage and determine if the vehicle can be driven to the facility or must be towed to the facility or to the location determined by the CRC manager. viii. If a resident driver is involved in any collision, CRC staff or medical staff must take a urine analysis and breathalyzer sample from the resident driver upon their return to the facility. Staff must record the test results in the CMS, accident report, and incident or information report according to standard procedure. ix. A resident involved in a collision whether driver or passenger must give a written statement to be included with the incident or information report. x. A 105 Incident Notification Report must be filed in accordance with SOP 105.02.01.001, Reporting of Major Incidents. b. Traffic Violations: Resident drivers are responsible for all violations or tickets received while driving and must notify CRC staff as soon as possible after receiving any moving citation. 7. Termination of a Resident Driver a. CRC staff members have discretion to suspend or terminate a resident driver at any time. b.
