GOVERNING POLICY STATEMENT It is the department’s policy to authorize specific individuals to possess department-issued firearms under the specific conditions described in department procedures. D. PURPOSE This SOP standardizes firearms, ammunition, firearm maintenance, storage, and inventories to ensure continuity throughout IDOC. E. RESPONSIBILITY 1. Facility Head a. Identify, in a field memorandum, staff to act as security manager, armory officer, and firearms instructor for the facility. b. Designate, in a field memorandum, secure areas to be used as the armory, sub-armory, or firearms locker. 2. Maintain firearm instructor certification from the Idaho Peace Officer Standards and Training (POST) Council. d. Directly oversee security operations with firearms e. Maintain certification in maintenance and repair of IDOC firearms. f. Oversee purchase of ammunition and range equipment F. DEFINITIONS 1. Armory Officer: A staff member specially trained in handling and maintaining firearms. 2. Facility: A building or residence—including the property and land where the building or residence is located—owned, leased, operated, or managed by the Board or Department. 3. Facility Head: The person primarily responsible for overseeing, managing, or operating a department facility. 4. Firearms Instructor: A department employee who is an Idaho POST certified firearms instructor. 5. Firearms Locker: A temporary storage area designed to secure firearm(s) and ammunition on a short-term basis. 6. Firearms Qualification: The demonstration of abilities to (1) handle firearms safely and (2) meet department proficiency criteria. 7. Firearms Training: The review and practice of firearms safety, fundamentals of marksmanship, firearms manipulation skills (drawing, holstering, reloading, malfunction clearance drills), moving and shooting, shooting while moving, shooting from different positions, use of cover, low guard, high guard, port arms, scanning, issuing verbal warnings, scenario based training, and use of force decisions. Training can include live fire scenarios or firearms simulator. 8. Staff: Any employee, volunteer, intern, contractor, or other authorized person who provides specific services, as assigned or requested by a superior, to meet department tasks. 9. Uniformed Staff: All security and food service personnel within the department. G. STANDARD PROCEDURES 1. General Statement a. This SOP provides guidelines for firearms acquisition, maintenance, and training. This SOP does not apply to issues related to the use of firearms that are addressed in SOP 109.00.01.001, Use of Force. This SOP also does not apply to any use of firearms, ammunition, or other supplies necessary for execution by firing squad. b. Department-issued firearms are only to be used for IDOC business and operations. Document Number: 152.002 1 Firearms Page Number: 4 of 17 Idaho Department of Correction c. Authorized staff may carry a department-issued firearm off duty in accordance with state and federal laws and this SOP. d. Firearms will only be issued to employees that have maintained a current firearms qualification. The Firearms Qualification Card will be issued to staff and must always be in the staff member’s possession when on duty. e. If necessary, a shift commander or other duty officer may authorize a firearm to be issued to staff not in possession of a Firearms Qualification Card if the staff member is on the work area’s Firearms Qualification List. f. Any staff who has pending felony charges or has been convicted of domestic abuse (misdemeanor or felony) is required to surrender their department- issued firearm and is ineligible to be issued a firearm. 2. Firearm Safety a. Staff are responsible for handling, maintaining, and securing their department-issued firearm and/or ammunition in a safe and secure manner at all times. b. Staff must not carry a department-issued firearm when intoxicated or under the influence of alcohol or drugs. c. Staff are prohibited from removing a department-issued firearm from the holster or other carrying device for any reason other than authorized purposes. Authorized purposes include tactical use, training and qualification, inspection, security, or cleaning, and maintenance. Any careless, flippant, or casual use or display of a firearm constitutes grounds for corrective or disciplinary action, up to and including termination. d. When handling a department-issued firearm, staff must treat the firearm as if it is loaded, point the firearm in a safe direction, keep their fingers off the trigger until ready to fire, and be aware of the backstops. e. Staff (whether on-duty or off-duty) are responsible for the safe storage of their department-issued firearms and/or ammunition and must utilize trigger or safety locks, safety holsters, security cases, safes, gun and ammunition lock boxes, etc. Staff are fully responsible for the cost of storing their department-issued firearms and/or ammunition at home. f. The facility head, Special Investigation Unit (SIU) chief, or their designee may, at their discretion, remove a department-issued firearm from any staff. g. Staff must report, in writing, to their immediate supervisor any use of over the counter or prescription medication/substance, or any physical ailment or injury that they reasonably believe could impair their ability or judgment to use a firearm. h. Only Simunition®, airsoft, or marked non-functioning training weapons will be used for training simulations. i. Staff will regularly practice safety skills during scenario training and while utilizing the firearm training simulator during in-service training. Document Number: 152.002 1 Firearms Page Number: 5 of 17 Idaho Department of Correction 3. Personal Firearms a. Personal firearms are not authorized for IDOC business. No personal firearms or ammunition will be allowed in residential facilities. b. With the approval of their facility head, a higher approval authority, or designee, staff may carry a personal weapon in a state vehicle during travel. These weapons are for off-duty use only. c. Staff who legally possess a personal firearm may bring the firearm and ammunition into an IDOC parking area, but the firearm and ammunition must be concealed and secured in a locked personal vehicle. Care must be taken to ensure that any person passing cannot see the firearm or know of its presence. The firearm must not be outside the vehicle unconcealed at any time while on IDOC property. d. If the staff’s vehicle is a motorcycle or open vehicle without a hard, enclosed passenger cabin, before arriving at the facility parking area, the staff must secure the firearm where any person passing cannot see it. The firearm must be secured in a locked compartment or a lockbox that is securely attached to the motorcycle or vehicle. 4. Armory Officers a. Each facility head will designate two staff to be armory officers for that site. b. All armory officers must complete armorer classes for handling and maintaining each make and model of firearms their facility has in inventory. 5. Ammunition a. The designated armory officer or lead instructor is responsible for ordering and purchasing ammunition and range equipment. All ammunition will be factory new for both training and duty. No reload or modified ammunition will be used in department-issued firearms. b. A division chief may authorize another type of ammunition if the type(s) identified in this SOP become unavailable or impractical to obtain due to cost, limited supply, etc. (For example, 9mm, 115 grain HP duty ammo might be replaced with 9mm, 124 grain HP or .223 caliber, 55 grain SP might be replaced with .223 caliber, 62 grain SP.) 6. Firearm Purchases a. The division chief or designee must approve all firearm purchases. The purchases must be from an approved vendor in accordance with state purchasing regulations. b. When purchasing a firearm for a facility, the facility must contact fiscal to get a quote from an approved vendor. The facility will then submit the requisition to purchase and will be sent a letter of intent from the vendor to be completed and signed by a lieutenant, section supervisor, or above. c. When a firearm is received, an armory officer must: Document Number: 152.002 1 Firearms Page Number: 6 of 17 Idaho Department of Correction i. Enter the purchase order as received. ii. Send the serial number to fiscal to be assigned a state ID tag. iii. Place the issued state identification (ID) tag in the file for new firearms received. iv. Complete an inspection of the firearm using the inspection sheet. v. Create a Firearm Data Sheet vi. Enter the firearm into the Firearms Master Inventory and the Monthly Inventory. vii. Ensure that a firearm file is created for each new firearm (in accordance with Section G.8.b of this SOP). 7. Authorized Modifications All firearms and equipment must remain in factory condition, except for the following modifications: a. Weapon mounted lights b. Grips c. Rail covers d. Slings e. Ambidextrous controls f. Reflex or red-dot sights g. Suppressors (optional for Correctional Emergency Response Team, Special Investigations Unit, and Probation & Parole) 8. Firearms Records a. Armory Files Documentation such as armory logs and inventories will be kept in a three- ring binder and organized by month and fiscal year (July 1 through June 30). Electronic versions are acceptable; however, if electronic versions are used, backup paper copies must be kept. b. Firearm Files i. The facility armory officer or designee is responsible for maintaining the firearm files. Each firearm will have an individual folder. The file will be labeled with the firearm make, model, state ID number, and serial number on the digital file. The digital folder will contain: 1) Firearm Data Sheet 2) Repair information/receipts 3) Maintenance requirements 4) Manufacturer’s data Document Number: 152.002 1 Firearms Page Number: 7 of 17 Idaho Department of Correction 5) Modification requests 6) Annual inspection sheets 7) The firearms file will also contain a copy of the Firearms Tracking Log. Required information includes, but is not limited to: a) Number of rounds fired (this can be an estimate) by date b) Inspection information c) Removed from service and returned to service information d) Any other information regarding the use, condition, and repair of the firearm 9. Storage of Firearms and Ammunition a. Each facility must have a field memorandum that designates an armory for secure storage of firearms, ammunition, and other force-related equipment. The field memorandum must also have procedures to secure and store firearms for visiting law enforcement personnel. b. A facility may designate a sub-armory for secure storage of firearms, ammunition, and other force-related equipment to provide quick access during emergency and non-emergency situations. Firearm lockers and emergency equipment rooms are considered sub-armories. c. Designated armory and sub-armory locations must have two secure points of access and provide maximum security and safety, adequate space, and climate control to minimize deterioration of contents. d. All armories must have an inventory that lists each firearm make, model, serial number, and ammunition count. Sub-armories designated for specific posts must have a label affixed identifying the specific post to which the firearms are assigned. 10. Armory Access and Documentation a. The keys to unlock an armory and sub-armory are highly restricted and must only be given to staff with authorized access. Each facility head will designate, by field memorandum, staff authorized to have access to the armory and/or sub-armory. The authorized access list must be posted at the armory or sub-armory entry point. All staff entering the armory or sub- armory must sign in and out using the Armory Access Log. b. The armory officer or designee is responsible for retrieving the logs by the 5th day of each month for review and filing in accordance with section G.8.a of this SOP. 11. Armory Inventory Control of Firearms and Ammunition a. Armory officers must maintain firearm and ammunition inventories. i. The armory officers are responsible for ensuring that master ammunition and firearm inventories are accurate and current. The armory officers will Document Number: 152.002 1 Firearms Page Number: 8 of 17 Idaho Department of Correction maintain a master inventory using the Firearms Master Inventory or digital version. The armory officers must ensure that any change is documented immediately on the facility master inventory. b. Facility managers, training, fiscal, and the department’s emergency coordinator will have access to each facility’s inventory at all times. c. Armory officers must complete an annual inventory of every weapon in the facility. d. Prison facility inventory requirements i. Armory officers must ensure that by the 5th day of each month, inventories of all ammunition and firearms in each armory or sub-armory are completed using the Ammunition Monthly Inventory and the Firearms Monthly Inventory. ii. An armory officer must also gather the previous month’s Armory Access Log and Firearms/Ammunition Logs. The armory officer is responsible for posting new logs for the current month and for reviewing and filing the previous month’s logs. iii. Each month, a designated armory officer must compare the monthly inventories with the master inventory and reconcile any discrepancies. e. Rotation Requirements i. Firearms assigned to armed posts (towers, transport, central control center, etc.) must be rotated on an annual basis. The armory officer must clean, lubricate, and inspect each firearm assigned to an armed post quarterly (January, April, July, and October) and document it in the individual firearm file. ii. Ammunition assigned to armed posts must be replaced with new ammunition quarterly. The ammunition removed from armed posts may be used as range/qualification ammunition. iii. Duty ammunition assigned to specific personnel in P&P must be replaced annually. 12. Firearms Repair and Inspection a. Any staff member who discovers a problem with a firearm must immediately report to a facility armory officer. Any firearm needing repair must be removed from service and clearly marked with a ‘DO NOT USE’ tag attached through the trigger guard. b. The armory officer must initiate repairs within 10 working days and document the repair on the firearm data tracking sheet. As soon as the firearm is repaired, it should be returned to service. c. Annual Inspection An armory officer must inspect all firearms annually to the manufacture specifications. Inspections are documented using a manufacturer inspection Document Number: 152.002 1 Firearms Page Number: 9 of 17 Idaho Department of Correction form. 13. Issuing Firearms for the Division of Prisons The following steps are used when issuing a firearm: 14. Returning Firearms to Storage a. Each firearm must be properly cleared before returning it to the armory or Functional Roles and Responsibilities Step Tasks Staff Member Requesting Firearm 1 Present a valid Firearms Qualification Card to the issuing staff. Issuing Staff 2 Visually inspect the Firearms Qualification Card, ensuring the staff member is currently qualified for the firearm. Note: The Firearms Qualification List may be used in lieu of the Firearms Qualification Card for the purpose of issuing firearms with the shift commander’s approval. Issuing Staff 3 1. If the qualification is current, issue the firearm and ammunition. Place the staff member’s Firearms Qualification Card in an area designated by field memorandum. Continue to Step 4. 2. If the qualification card is not current, do not issue the firearm and immediately notify the shift commander of the discrepancy. Do not proceed to any further steps in this list. Staff Member Issued Firearm 4 If the firearm is issued or removed from a secure storage location, complete the checkout process using the Firearms/Ammunition Log. Staff Member Issued Firearm 5 Before beginning tour of duty, visually and physically inspect the firearm in accordance with training. Staff Member Issued Firearm 6 1. After the tour of duty, unload the firearm in accordance with training. 2. Return the firearm and ammunition to the designated armory or sub-armory (see section G.14 of this SOP for unloading instructions) 3. Complete the check-in process using the Firearms/Ammunition Log. Document Number: 152.002 1 Firearms Page Number: 10 of 17 Idaho Department of Correction sub-armory. When available, a second staff member should supervise the process. b. To clear the firearm the following steps must be followed: i. Remove the firearm from the holster and point muzzle into a clearing barrel. ii. Remove magazine. iii. Secure magazine in pocket or other safe location. iv. Rack the slide three times (Do not attempt to catch the ejected round). v. With the slide locked open, visually, and physically inspect the chamber to ensure the chambered round was ejected. vi. Send slide forward. vii. Re-holster the firearm 15. Firearm Disposal a. The fiscal department must approve, in writing, the disposal of firearms and/or the removing of firearms from a work site inventory. b. Disposal of state firearms will be in accordance with SOP 114.03.03.010, Inventoriable Fixed Assets, and applicable state laws and rules. c. After disposal the armory officer will adjust inventories in accordance with section G.11 of this SOP. 16. Firearms Instructors a. Each facility head will designate a lead firearms instructor to maintain a list of all firearms instructors assigned to that area. The list will contain the employees’ names, associate numbers, certification dates, and certification expiration dates. b. The following standards apply to all firearms instructors: i. Serve at the discretion of the facility head. ii. Maintain current POST firearm instructor certification. iii. Provide firearms instruction a minimum of eight hours a year and receive a minimum of eight hours of continuing education as a student to maintain their instructor certification. iv. Re-certify annually in accordance with POST standards. 17. Qualification and Training a. Staff approved to train on the range must have a firearms instructor present to use the IDOC firing range and/or department firearms and ammunition. b. All uniformed prison staff who successfully qualify with any department firearm will be issued a Firearms Qualification Card. For the Division of Prisons, a designated firearms instructor is required to maintain a list of all facility personnel that are firearms qualified using the Firearms Qualification List. The designated firearms instructor will update the list quarterly. i. The Firearms Qualification List is used by administrative staff and trainers to monitor the number of staff members who are firearms qualified and to list which firearms they are qualified for. It is also used to track qualification expiration dates, and to make decisions regarding training and qualification needs. ii. The Firearms Qualification List is also used by incident commanders or designees to see who on shift is qualified and on which firearms to expedite post assignment and recall. d. Armed Post Training Annual qualification is not considered armed post training. Security staff assigned to an armed post on a permanent or consistent basis must complete post-specific training on a semi-annual basis that includes training on the following: i. Vehicle stops (if applicable) ii. Low-light shooting iii. Use of Force iv. Combat shooting v. Facilities may require the 100-yard rifle qualification for specific posts, for example towers. vi. Rules of Engagement vii. Scenario-based training e. Certification and Requalification Requirements i. Initial Certification 1) Initial training and certification for shotgun is mandatory for all uniformed staff at all prison facilities unless their facility does not keep weapons and they are exempted from training by their facility head. 2) Initial training and certification for pistol is mandatory for all uniformed staff in Probation & Parole. ii. Facility heads will determine re-qualification requirements annually on the rifle, shotgun, less lethal shotgun, and pistol. Facility heads will make the determination based on relief factors, armed posts, and armed assignments, (e.g., towers, outside patrol, transport, control center, P&P task forces etc.) f. Independent Practice i. Staff may use their department-issued firearm to practice on their own if Document Number: 152.002 1 Firearms Page Number: 12 of 17 Idaho Department of Correction the practice is conducted in a safe environment. ii. Staff may purchase their own practice ammunition upon the approval of the director or designee and if the ammunition is consistent with ammunition purchased by the department. The department will not reimburse the cost of the purchased ammunition. g. Remedial Training Procedures If a security staff member who is required to be certified for a specific post fails to complete firearms training or qualification requirements successfully, these steps must be followed: Functional Roles and Responsibilities Step Tasks Firearms Instructor 1 1. If time permits, allow the staff member to re- shoot the course-of-fire once. 2. If the staff member successfully completes the course-of-fire, issue a current Firearms Qualification Card or updated pistol qualification sheet for Probation & Parole. (The process ends here). 3. If the staff member fails to complete the course- of-fire, destroy the staff member’s Firearms Qualification Card and if applicable issue a new card that reflects any current firearm qualification (proceed to step 2). Firearms Instructor 2 Notify the facility head or designee in writing of the need for remedial training. Facility head or Designee 3 Select a facility firearms instructor to provide remedial firearms training. Firearms Instructor 4 1. Provide the staff member a minimum of two hours of remedial training and practice before the next qualification. 2. Document the training using Firearms Remedial Training Documentation. Firearms Instructor 5 Following remedial training, provide the employee with an opportunity to qualify. Allow no more than three qualification attempts on a qualification day. Firearms Instructor 6 If the employee qualifies, destroy the employee’s Document Number: 152.002 1 Firearms Page Number: 13 of 17 Idaho Department of Correction 18. Discharge of a Firearm a. Anytime a firearm is discharged other than during training or uses of force in accordance with SOP 109.01.01.001, Use of Force, staff designated by the facility head will investigate the incident. The goals of the process include, Functional Roles and Responsibilities Step Tasks Firearms Qualification Card, and issue a new one. Or complete updated pistol qualification sheet for probation and parole (The process ends here). If the employee fails to qualify, proceed to step 7. Firearms Instructor 7 Notify the facility head or designee in writing. Notify the employee that they have two weeks before the next attempt to qualify. Reschedule the employee for the final qualification attempt. Firearms Instructor 8 For the final qualification attempt: 1. If the employee qualifies, destroy the employee’s Firearms Qualification Card, and issue a new one. Or pistol qualification sheet for Probation & Parole. (The process ends here). 2. If the employee fails to qualify, notify the facility head or designee in writing and forward all relevant documentation regarding training and qualification attempts. Facility Head 9 1. Review the information and determine if the staff member has received proper training, qualification opportunities, and ensure other provisions contained in this SOP have been followed. 2. If it is determined that training and qualification have been conducted appropriately, consult with the IDOC’s Human Resource services (HR) before taking corrective or disciplinary action. 3. If it is determined that the employee would benefit from additional remedial training or that provisions contained in this SOP were not followed, develop a training plan to include an additional requalification attempt. Immediately ensure the situation is made safe and the events of the discharge are documented. ii. Reassign the responsible staff member to an unarmed post and suspend their firearms qualification card until the facility head approves the responsible staff member to return to an armed post. iii. Secure the weapon and give it to the designated armory officer for inspection to ensure it is in working order and meets manufacture’s specifications. iv. Review the incident and take appropriate action. b. When a discharge of a firearm occurs, take the following steps: Note: SOP 109.01.01.001, Use of Force details how staff are authorized to use firearms in the performance of their official duties. Functional Roles and Responsibilities Step Tasks Staff 1 Make the firearm safe, immediately contact the shift commander and/or supervisor, and request EMS, if needed. Shift Commander or Supervisor 2 1. Assign a staff member to supervise the situation. 2. If applicable, notify local law enforcement. 3. Contact the facility head or designee. Scene Supervisor 3 1. Secure firearm and ammunition using proper evidence collection procedures (see SOP 116.02.01.001, Custody of Evidence). 2. As soon as practical, have the employee report to the supervisor or shift commander. 3. When applicable, take photographs and diagram the scene. 4. Complete an Information Report and ensure that involved staff members complete information reports. 5. Forward everything related to the event to the supervisor or shift commander. Shift Commander or Supervisor 4 Notify HR of the incident and provide a point of contact for any Information Reports. Document Number: 152.002 1 Firearms Page Number: 15 of 17 Idaho Department of Correction Functional Roles and Responsibilities Step Tasks Shift Commander or Supervisor 5 If a negligent discharge resulted in an injury, the following must also occur along with the remainder of this process: 1. The responsible staff member will be removed from the scene and may be isolated at the discretion of the director or designee. 2. An outside law enforcement agency must investigate the incident. Shift Commander or Supervisor 6 1. Ensure the firearm is taken out of service and tagged ‘DO NOT USE’ until all inquiries into the incident have been completed and a trained armory officer has inspected the firearm. 2. Secure the employee’s Firearms Qualification Card. 3. Reassign the responsible staff member to an unarmed post. 4. Instruct the responsible staff member to report to the facility head the next working day. Shift Commander or Supervisor 7 1. Complete a 105 Report in accordance with SOP 105.02.01.001, Reporting and Investigation of Major Incidents. 2. Ensure that involved staff have submitted Information Reports. 3. Forward all the information to the facility head. Facility Head 8 1. Meet with the responsible staff member as soon as possible to complete a check-in. 2. Provide the responsible staff member information regarding the rest of the process, including estimated timelines. (Continue to keep the responsible staff member informed until the process is completed.) Facility Head 9 In consultation with division leadership, determine the following: 1.
