Court Proceedings within a Facility
POLICY STATEMENT
It is the policy of the Idaho Board of Correction that the Idaho Department of Correction
(IDOC) and its contractors develop and maintain an adequate method to ensure offenders
have direct access to the courts in order to pursue constitutionally mandated legal actions
and qualified legal claims .
PURPOSE
The purpose of this policy is to communicate the Board’s management philosophy regarding
offender access to court matters .
SCOPE
This policy applies to all procedures created under the authority of this policy and to IDOC
facilities, assigned staff, and offenders under the jurisdiction of the IDOC .
RESPONSIBILITY
The director of the IDOC and chief of the Division of Prisons (in consultation with the chief of
the Division of Education, Treatment, and Reentry) are responsible for overseeing the
development, implementation, and monitoring of standard operating procedures (SOPs) that
provide guidance on or establish, at a minimum, the following:
• What qualified legal claims are;
• Offender procedures to request access to courts assistance, services, and
resources ;
• Offender-to-offender assistance guidelines;
• Offender procedures for filing pleadings and other documents with a court;
• Service of document procedures;
• Telephone hearings and attorney telephone calls ; and
• Procedures for offenders to store their excess legal materials.
