REFERENCES Standards for Health Services in Prisons, P-57. 04.00.00. DEFINITIONS Facility Health Authority: The on-site Health Authority or senior health staff assigned. Medical Authority: Idaho Department of Correction Health Services Chief. Medical Director: A physician (M.D.) either employed by the Idaho Department of Correction or the physician in charge if medical services are privatized. Mid-Level Provider: Physician Assistant or Nurse Practitioner. Qualified Health Professional: Physician, physician assistant, nurse practitioner, nurse, dent ist, mental health professional and others who by virtue of their education, credentials, and experience are permitted by law within the scope of their professional practice are to evaluate and care for patients. Regional Health Manager: The individual assigned as the primary manager who is administratively responsible for the delivery of medical services if health services are privatized. 05.00.00. PROCEDURE Victims of sexual assault shall be transported to the nearest IDOC medical facility (facility infirmary, community hospital ER, etc.) where appropriate facilities and trained medical staff can institute immediate treatment and gathering of evidence. DIRECTIVE NUMBER: 401.06.03.057 SUBJECT: Sexual Assaults PAGE NUMBER: 2 of 2 This standard is not to be confused with P -68 ‘Forensic Information.’ With victim consent, qualified health providers are permitted to gather evidence from victims who have been sexually assaulted. With victim’s consent, the examination at a hospital or other appropriate medical care facility shall include the collection of evidence, using a kit approved by the local legal authority. Prophylactic treatment and follow-up for sexually transmitted diseases (such as HIV, gonorrhea, etc.) shall be offered to all victims of any sexual assault. Provision shall be made for testing and counseling (i.e., Hepatitis B, HIV, etc.) as is deemed appropriate by the facility health authority. A complete mental health evaluation shall be performed by a mental health professional following the physical examination and treatment. This shall be for the purpose of crisis intervention counseling and for the purpose of scheduling long-term follow-ups as indicated. A complete report shall be made to the warden of the institution or his/her designee to effect a separation of the victim from his or her assailant in the housing assignment. The collection of medical information and evidence from the perpetrator by health care staff would not be permitted under standard P -68 “Forensic Information.” ___________________________________________ _____________________ Administrator, Institutional Services Division Date
