SCOPE
This standard operating procedure (SOP) applies to all IDOC residential facilities
from which residents might be released.
Version Summary

C. GOVERNING POLICY STATEMENT
It is the policy of the Board of Correction that IDOC standard procedures for
notifying sex offenders of the obligation to register as sex offenders in the state of
Idaho.
D. PURPOSE
To establish standard procedures for notifying sex offenders of the obligation to
register as sex offenders in the state of Idaho.
E. DEFINITIONS
1. Resident: A person who has been convicted of a crime against the laws of the
state and ordered into the care and custody of the Board of Correction.
Resident includes any use in Idaho law, Board of Correction rule, or IDOC policy
or procedure of the terms “offender(s),” “prisoner(s)”, “inmate(s)”,
“incarcerated person(s)”, or any other term referring to a person residing in a
correctional facility in the care and custody of the Board of Correction.
F. STANDARD PROCEDURES
1. Sex Offender in Idaho Code
Idaho code identifies all convictions requiring sex offender registration in § 18-
8304(a).
2. Notification to the Sex Offender
a. IDOC must provide written notification prior to release to any sex offender
resident of the duty to register with the sheriff of the county in which the
sex offender resides or is temporarily domiciled.
b. The original Notice of Duty to Register by Sex Offender will be signed by the
resident. The department shall retain one (1) copy, provide one (1) copy to
the offender, and submit one (1) copy to the central registry within three (3)
working days of release.
c. This applies to the following:
i. To all Idaho convictions that fit the definition of a sex offender prior to July
1, 1993, if the person is still incarcerated, on probation, or on parole.
ii. To anyone convicted of a sex offense that fits the definition of a sex
offender (Idaho and non-Idaho) after July 1, 1993.
iii. To all out of state convictions that fit the definition of a sex offender and
are currently under supervision.

iv. To anyone who enters the state of Idaho on or after July 1, 1993, and
who has pled guilty or has been found guilty in another state, territory,
commonwealth, or jurisdiction of the United States that is substantially
equivalent to the definition of a sex offender.
