POLICY OF THE DEPARTMENT It is the policy of the Department to provide services mandated by courts, statute, and the Idaho Department of Corrections by furnishing information regarding an offender within the Criminal Justice System outlining options to alter his behavior to that which is acceptable by society and allowed by statute. Presentence Report Composition The basic part of the officer's investigation is that of communicating in writing to the court, and others, all information pertinent to a particular case. The value of the report will be in direct ratio to the care, diligence, and skill used in the investigation. However, such investigations, no matter how thorough and skillful, will be of little or no value unless the information obtained thereby is reported to those for whom it is intended (the court, the Probation and Parole Division, the prison, etc.) with accuracy, clarity, coherence, objectivity, conciseness and with rehabilitative goals in mind. Legal Guidelines for Presentence Report A presentence investigation is conducted following adjudication of guilt. The gathering of relevant information to be incorporated in the presentence investigation report is an integral part of such report. It is essential that the report contain accurate information that will be of value to the court. The probation/parole officer or presentence investigator is responsible for the contents of the report. Supreme Court Rule 32 (37) shall be followed in the development of standards and procedures governing the preparation of presentence investigations and reports. _________________________________ _______________ Director, Department of Correction Date
