Purpose The purpose of this field memorandum is to provide specific guidelines that are unique to this facility in order to fully implement standard operating procedure405.02.01.001. General Statement This field memorandum is subject to revision at the discretion of the Warden of this facility, Chief of the Operations Division (or designee), or Director of the Idaho Department of Correction. Authorized Photocopies2References2 ACCESS TO THE PARALEGAL AND RESOURCE MATERIALS Signed Access to Court Request Forms must be placed in the resource center locked boxes located in the foyers of each unit. Offenders may not come to the resource center without being on the callout. Access to Court Request Forms will be picked up from all locked boxes on weekdays excluding holidays, and subject to institutional need and emergencies. The paralegal determines and develops the callout list from the request forms and forwards it to the appropriate staff to post on the CCTV system. It is the offender’s responsibility to check the resource center callout for scheduled appointments. Resource center appointments are scheduled in one-hour blocks. The paralegal may grant additional time if an offender can demonstrate that he has a pending deadline and is able to complete the required paperwork within the additional time provided. RESTRICTIVE HOUSING Restrictive housing offenders must fill out an Access to Courts Request Form and have unit staff place it in the resource center Access to Courts box. Access to Court request forms will be picked up from restrictive housing daily on weekdays excluding holidays, and subject to institutional need and emergencies. Resource Center paralegal will visit restrictive housing offenders at least twice a week, subject to holiday, institutional need and emergencies. Offenders may be seen more often if the situation is warranted. Indigent offenders must submit an Access to Court Request for indigent legal supplies. STORAGE OF EXCESS LEGAL MATERIALS A request to store excess legal materials form must be completed and signed by unit staff prior to storage of any legal materials in the resource center. Upon receipt the paralegal will make an appointment with the offender. Excess legal material stored in the Resource Center will be inventoried annually. ATTORNEY TELEPHONE CALLS Offenders may call their attorneys from the unit offender phones by using their inmate phone account or calling collect. If their attorneys do not accept their collect calls, the offender will have to write a letter. Calls will not be made from the Resource Center. It is the offender’s responsibility to notify the paralegal of any court orders for telephone hearing by providing a copy of the court order or notice of hearing at least 24 hours in advance. AUTHORIZED PHOTOCOPIES Copies will be made as outlined in SOP 405.02.01.001 Access to Courts. Copies will not be made of concern forms, grievances, certificates, parole packages, etc., unless they are attached to a legal pleading that is ready to be mailed. Extra copies will not be made. Copies of any material for any attorney will not be made under any circumstance unless it is opposing counsel, pursuant to court rules.
