Open to the public: Ye s No Redacted version available: Yes No SCO PE This standard operating proc edure (SOP) applies to all Divis ion of Probation and Parole staff m embers involved in the direct supervision and m anagem ent of probationers and parolees under the juris diction of the Idaho Departm ent of Correction (IDOC) as agents of the court and the Commission of Pardons and Parole (the Parole Commission). RESPONSIBILIT Y Div ision Chief/Deputy Chie f The c hief and deputy c hief of the Divis ion of Probation and Parole are responsible for overseeing probation and parole s upervis ion and ensuring the implementation of this SOP. District M anage rs (or de signees) Dis trict m anagers (or designees ) are res ponsible for implementing this SOP and for ensuring that PPOs are following the guidelines , standards, and procedures provided herein. Probation and Parole Office r s Probation and parole offic ers (PPOs) are responsible for practicing the guidelines , standards and procedures provided herein. GENERAL REQ UIREM ENTS The Divis ion of Probation and Parole us es the Idaho Response M atrix (IRM) to establis h potential rewards and s anc tions to addres s a probationer’s or parolee’s com pliance and non-compliance with the c onditions of their release. The use of DJT is a sanction which c an be used in respons e to serious non-compliant behaviors as identified in the IRM, with cons ideration given to any protective fac tors the probationer or parolee has in plac e. 1. Authorization of Discre tionary Jail T ime In accordance with Idaho crim inal rules and statutes , PPOs are authorized to impose up to 48 hours of DJT when the c ourt or Parole Commission orders this as a c ondition of s upervis ion. In order to impos e up to 72 hours of DJT, an Order Finding Probable Caus e (Appendix C) signed by the jurisdictional authority is required. 2. Imposition of Discre tionary Jail T ime The following s teps will be taken when the im pos ition of DJT is deem ed appropriate for the s ituation: Idaho Departm ent of Correction Control Number: 701.04.02.007 Version: 3.0 T itle : Discretionary Jail Tim e Page Numbe r: 3 of 4 Functional Role s and Re sponsibilitie s Ste p T asks (CIS steps are in bold) Probation and Parole Office r (PPO) 1 Ensure DJT is rec ommended by the IRM and appropriate for the offender. PPO 2 Review the order of probation or the parole s upervis ion c onditions to ens ure the following: • DJT was ordered as a condition of supervis ion • Sufficient days of DJT rem ain (if DJT has been previously im pos ed) PPO 3 Staff the c as e with a s upervis or. PPO 4 If imposing les s than 48 hours of DJT: • Com plete and sign the following form : o O rder for Discretionary Jail Tim e (Appendix A or B) If im posing between 48 and 72 hours of DJT: • Com plete and sign the following form s: o Affidavit of Probable Caus e (Appendix C) o O rder Finding Probable Cause (Appendix C) o O rder for Discretionary Jail Tim e (Appendix C) District M anage r (or de signee) 5 Review the c ase to ensure the following: • DJT was ordered as a condition of supervis ion and s uffic ient days rem ain for us e. • The c orrective plan m eets the guidelines of the IRM. • The applicable form s are c om pleted and c orrect. District M anage r (or de signee) 6 Deny, modify, or approve the plan. Docume nt de cision in the Corre ctions Inte grate d Syste m (CIS) as a case update . If the plan is denied, the process ends here. If the plan is approved, sign the form (s ) and return to the PPO. Idaho Departm ent of Correction Control Number: 701.04.02.007 Version: 3.0 T itle : Discretionary Jail Tim e Page Numbe r: 4 of 4 PPO 7 Submit and file c opies of the applicable form(s ): • A c opy will be sent to the jurisdictional authority as notific ation. o Probationers : A c opy will be s ent via fax or elec tronically to the s entenc ing judge, prosecuting attorney and las t defense attorney of rec ord. o Parolees: A c opy will be s ent via fax or elec tronically to designated pers onnel at the Parole Commission. • A c opy will be left at the jail where the DJT is to be s erved. • A c opy will be placed in the c entral file. PPO 8 Notify the offender of DJT to be im pos ed. • Res train the offender and trans port to jail or • Notify offender of date/tim e to s elf-surrender and trans port to jail at that tim e. DEFINIT IONS Discretionary Jail T ime (DJT ): A s us pended jail sentence - ordered as a condition of probation or parole - to be im posed at the discretion of the s upervising probation and parole offic er.
